Please read these Terms of Use carefully before using the Arrowhead Neurosurgery Compendium. They set out the basis on which the Compendium is provided and the limits of our responsibility.
These Terms of Use (the "Terms") govern your access to and use of the Arrowhead Neurosurgery Compendium at arrowheadneurosurgery.com, together with any subdomain, mobile-optimized version, application, function, data feed, or other service provided through it (collectively, the "Service"). By accessing, browsing, querying, or otherwise using the Service in any way, you (the "User") acknowledge that you have read, understood, and agree to be bound by these Terms and by the Privacy Policy. If you do not agree, you must not use the Service.
"Compendium," "we," "us," or "our" means Arrowhead Neurosurgical Medical Group, which operates the Service, together with its members, officers, employees, contractors, contributors, advisors, and licensors.
"Content" means all text, code, design, branding, calculators and scores, lookups, search functions, structured data, summaries, generated responses, images, audio, video, and any other material made available through the Service.
"Curated Data" means structured datasets assembled, normalized, and tagged from primary public sources, including the guideline corpus, the bedside score implementations, the evidence explorer of landmark trials, the journal-watch literature feed, and the industry-news feed.
"User Submission" means any text, query, comment, or other input you transmit to the Service.
"AI System" means any machine-learning model, large language model, neural network, retrieval-augmented generation system, or analogous automated system used to generate responses.
The Service is an independent educational reference for licensed clinicians, trainees, researchers, and students. It aggregates and presents information drawn from primary public sources, including PubMed and the NCBI E-utilities, ClinicalTrials.gov, and the published practice guidelines of professional societies and bodies such as the American Association of Neurological Surgeons, the Congress of Neurological Surgeons, the American Heart Association and American Stroke Association, the Brain Trauma Foundation, AO Spine, the North American Spine Society, and NICE, together with original Curated Data and original written content.
The Service is provided free of charge at this time and does not require user accounts. There is no billing, subscription, or paid tier as of the effective date of these Terms. The Service may be offered during a defined commentary or review period and may change, be suspended, or be withdrawn at any time.
The Service is not, and does not constitute, medical advice, a medical opinion, a medical device, a clinical decision-support tool intended for regulatory clearance, a HIPAA-covered service, or a substitute for the professional judgment of a qualified clinician. The Service does not create a physician to patient or clinician to patient relationship. Nothing in the Service is an instruction to take or withhold any course of action for any individual.
Any decision regarding the diagnosis, treatment, or management of any individual patient must be made by a qualified, appropriately licensed clinician who has personally evaluated that patient, based on that patient's specific circumstances, the current primary sources, and the standards and protocols of the clinician's own institution. You must independently verify every recommendation, threshold, dose, score, and citation against the cited source and current authoritative references before relying on it. The Service is not intended for time-critical or emergency decision making.
The Service is intended for adults aged 18 or older and is designed for use by licensed healthcare professionals and those training under their supervision. By using the Service you represent that you are at least 18 and have the legal capacity to enter into these Terms in your jurisdiction. The Service is not directed at children, and we do not knowingly collect data from children under 13. It is not intended for patients or members of the public to self-diagnose or self-treat.
You agree to use the Service only for lawful purposes and only in a manner that does not infringe the rights of, restrict, or inhibit any other person's use of the Service.
Do not enter patient names, dates of birth, addresses, telephone numbers, email addresses, medical record numbers, photographs, biometric identifiers, full-face images, or any other information that could identify a patient or third party into any input field, calculator, score, search box, assistant, feedback form, or other feature of the Service. The Service is not a HIPAA business associate, is not a covered entity, and provides no Business Associate Agreement.
You are solely responsible for ensuring that any clinical input you provide has been fully de-identified and that your use of the Service complies with all privacy, security, and data-protection laws applicable to you and your jurisdiction, including, without limitation, HIPAA in the United States, the GDPR in the European Union, the UK GDPR and the Data Protection Act 2018 in the United Kingdom, and analogous laws elsewhere.
The Service draws on third-party sources and on automated retrieval and summarization. Source material may be incomplete, outdated, superseded, mis-indexed, or in error, and guidelines change over time. Automated feeds and the guideline assistant may retrieve, rank, classify, or summarize material imperfectly. The guideline assistant uses a third-party AI System to generate responses from the indexed sources; such responses may be incomplete or may not reflect the most current guidance, and must be checked against the cited source. We make no representation that any calculator, score, summary, generated response, classification, ranking, citation, or external link is accurate, complete, current, or fit for any clinical, regulatory, or other purpose. You bear the entire risk arising from your reliance on any output of the Service.
The Service, the Content, the Curated Data, the underlying source code, the visual identity, the user-interface design, the prompt and retrieval architecture, and the name "Arrowhead Neurosurgery Compendium" and associated branding are owned by Arrowhead Neurosurgical Medical Group and are protected under copyright, trademark, trade-secret, and other applicable laws. Source documents, guideline text, and data drawn from third parties remain the property of their respective owners and are presented for educational reference with attribution to the cited source. Materials reproduced from third parties, such as the Rhoton Collection of the American Association of Neurological Surgeons and the Neurosurgical Research and Education Foundation, remain subject to the terms and attribution requirements of their owners.
The Service links to and embeds third-party content, including journal articles, ClinicalTrials.gov records, society pages, and externally hosted videos. We do not control and are not responsible for the availability, accuracy, content, or practices of any third-party site or service, and a link or embed does not imply endorsement. Your use of any third-party content is governed by that third party's own terms.
You may not, without our prior written permission, scrape, crawl, harvest, bulk-download, or systematically extract the Content or Curated Data; use the Service or its Content to train, fine-tune, or evaluate any AI System; resell, sublicense, or commercially exploit the Service; circumvent any access control or rate limit; or interfere with the integrity or performance of the Service.
If you submit a comment or suggestion through the feedback option, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, and incorporate that feedback for any purpose without obligation or attribution. Do not include any confidential or patient-identifiable information in feedback.
The Service is provided "as is" and "as available," without warranty of any kind, express or implied, including without limitation any warranty of merchantability, fitness for a particular purpose, accuracy, completeness, currentness, non-infringement, uninterrupted availability, or error-free operation. Without limiting the foregoing, we do not warrant that any calculator, score, summary, AI-generated output, classification, ranking, citation, or external link is accurate, current, or fit for any clinical or other purpose. You bear the entire risk arising from the use of the Service.
To the maximum extent permitted by applicable law, in no event shall Arrowhead Neurosurgical Medical Group or any of its members, officers, employees, contractors, contributors, advisors, or licensors be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages, or for any personal injury, death, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising from or related to (a) your access to or use of, or inability to use, the Service; (b) any clinical, diagnostic, treatment, or other decision made on the basis of any output of the Service; (c) any inaccuracy, omission, error, or outdatedness in any Content; (d) any third-party content or site linked from or embedded in the Service; or (e) any unauthorized access to or alteration of your transmissions or data, regardless of the form of action and even if we have been advised of the possibility of such damages. To the extent any liability cannot be disclaimed, our aggregate liability is limited to one hundred United States dollars (US $100).
You agree to defend, indemnify, and hold harmless Arrowhead Neurosurgical Medical Group and its members, officers, employees, contractors, contributors, advisors, and licensors from and against any and all claims, demands, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to (a) your use of the Service; (b) any clinical decision you make in reliance on the Service; (c) any User Submission you transmit; (d) your violation of these Terms or of any applicable law or right of a third party; or (e) your input of any protected, sensitive, or identifiable information.
We may, at our sole discretion and without prior notice, suspend, restrict, or terminate access to the Service, in whole or in part, for any reason. Sections 4, 6, 7, 8, 10, and 12 through 18 survive any termination.
We may revise these Terms at any time. The current version will be posted at this URL with an updated effective date. Your continued use of the Service after the effective date of any revision constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Service.
These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in California, and you submit to the personal jurisdiction of those courts. To the extent permitted by law, you waive any right to a jury trial and any right to participate in a class action.
If any provision of these Terms is held invalid, illegal, or unenforceable, the remaining provisions remain in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to be enforceable while reflecting the original intent. These Terms, together with the Privacy Policy, constitute the entire agreement between you and us concerning the Service and supersede any prior agreement on the same subject.
